Pursuant to the Agricultural Improvement Act of 2018 (2018 Farm Bill), codified at 7 U.S.C. § 1639o, the term “hemp” is defined as the plant Cannabis sativa L. and any part of that plant, including seeds, derivatives, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a Delta-9 tetrahydrocannabinol (Delta-9 THC) concentration of not more than 0.3% on a dry weight basis. Under this federal definition, only the Delta-9 THC concentration is relevant for determining hemp status, not tetrahydrocannabinolic acid (THCa).
All products sold by Hyper Hyve LLC, doing business as Dope Bee Farms, a licensed hemp producer under the United States Department of Agriculture (USDA), comply with the 2018 Farm Bill and Wisconsin Statute § 94.55, which adopts the federal definition of hemp and authorizes the production, processing, and sale of hemp containing no more than 0.3% Delta-9 THC on a dry weight basis. Our hemp-derived products, including those containing Delta-9 THC and THCa, are tested by independent third-party laboratories to ensure Delta-9 THC levels remain below the 0.3% threshold, as required by Wis. Admin. Code ATCP § 22.10. Certificates of Analysis (COAs) confirming compliance with pre-harvest and post-harvest testing requirements are available upon request, verifying that our products meet both federal and Wisconsin standards for hemp.
Under the Supremacy Clause, Article VI, Section 2 of the U.S. Constitution, federal law preempts conflicting state laws, ensuring that hemp as defined by 7 U.S.C. § 1639o is removed from the Controlled Substances Act (21 U.S.C. § 802) and is lawful. However, Wisconsin law, per Wis. Stat. § 961.41(3g)(e), prohibits certain hemp-derived products containing intoxicating cannabinoids, such as Delta-8 THC, unless explicitly authorized. Our products are formulated to comply with these restrictions and are not intended to produce intoxicating effects beyond the permitted Delta-9 THC threshold, as confirmed by our COAs.
