    Under the Supremacy Clause, Article VI, Section 2 of the U.S. Constitution, federal law preempts conflicting state laws, ensuring that hemp as defined by 7 U.S.C. § 1639o is removed from the Controlled Substances Act (21 U.S.C. § 802) and is lawful. However, Wisconsin law, per Wis. Stat. § 961.41(3g)(e), prohibits certain hemp-derived products containing intoxicating cannabinoids, such as Delta-8 THC, unless explicitly authorized.
